What is a deceased estate transfer?

When someone passes away and leaves behind real estate, the property must be legally transferred before it can be sold, retained, or distributed. This process may involve transferring the property into the name of the executor or administrator if there is a Will or Letters of Administration. Alternatively, if the property was jointly owned, a survivorship application may be required to transfer ownership to the surviving party. Both are legal requirements and form part of finalising the estate.

What’s involved in a deceased estate property transfer?

We offer end-to-end support to help make the process as smooth and stress-free as possible. Below are some of the ways we can assist during this time.

  • We handle the legal process of transferring the property title into the name of the appointed executor or administrator, as per the Grant of Probate or Letters of Administration.

  • If the deceased owned the property jointly with another person (as joint tenants), we can help the surviving owner lodge a survivorship application to have the title updated in their name.

  • We prepare and lodge all required forms with Landgate to officially update the title and ensure the transfer is registered correctly.

  • Already have a solicitor managing the estate? We’ll liaise directly with them to ensure everything is aligned and nothing falls through the cracks.

  • Once the property is in the executor’s name, we can assist with transferring it to beneficiaries in accordance with the Will or court order, or prepare the property for sale.

  • We keep you informed of key deadlines and ensure all legal obligations are met, giving you peace of mind throughout the process.

  • To begin, we’ll usually require the following documents:

    Grant of Probate or Letters of Administration: this confirms the legal authority of the executor or administrator to act on behalf of the estate.

    Death Certificate: this is a standard document needed for any property or title transfer.

    Certificate of Title: If you don’t have it on hand, we can help locate it through Landgate.

    The Will (if applicable): this guides us on how the property should be dealt with, in line with the deceased’s wishes.

    Executor or Administrator Details: we’ll need full contact and ID details for the person authorised to act on behalf of the estate.
